Privacy policy

Short version

This site sets no cookies, runs no analytics, shows no ads, and has no login. Nothing you do here is tracked or profiled. Your browser address is seen by the company that hosts the site, the same way it is on any website, and it is used to serve you the page and to stop abuse. A YouTube trailer only loads if you press play on it. Some screenshots are still being loaded from itch.io, which is explained further down.

Server log files

This site is hosted by Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA. When you open a page, the hosting provider's servers automatically record:

• your IP address,
• the date and time of the request,
• the page or file requested,
• the amount of data sent,
• the browser and operating system your device reports,
• the page you came from, if your browser sends one.

These logs are needed to deliver the site, to keep it stable, and to investigate attacks or abuse. The legal basis is Article 6(1)(f) GDPR, the legitimate interest in running a working and secure website. The logs are not combined with anything else and are not used to identify you. How long Cloudflare keeps them is set by Cloudflare. This site does not read them, evaluate them, or store them anywhere else.

Cloudflare delivers this site from a worldwide network of servers, which is why the server nearest to you answers your request. Cloudflare is based in the United States, so data may be processed both inside the European Economic Area and in the United States. A data processing agreement under Article 28 GDPR has been concluded with Cloudflare; it is published at cloudflare.com/cloudflare-customer-dpa and includes the EU standard contractual clauses. Cloudflare is also certified under the EU-US Data Privacy Framework. Cloudflare's own privacy policy is at cloudflare.com/privacypolicy.

Cookies and local storage

This site sets no cookies at all.

Two entries are written to your browser's local storage:

• the language you picked with the EN and DE buttons, stored as "en" or "de";
• whether you switched the site to light or dark, stored as "light" or "dark".

They are there so the site does not forget your choices on the next page. They contain nothing about you, they are never sent anywhere, and they are readable only by this site. Under Section 25(2) of the German TDDDG both count as strictly necessary for a function you asked for, so no consent banner is required. Clearing your browser data removes them.

If you never touch either switch, nothing is written at all. The site then follows the language and the light or dark setting your device already reports.

Game downloads

No game files are stored on this server. Every download button is a link to that game's page on itch.io, and nothing is sent anywhere until you click one. From the moment you do, you are on itch.io and their privacy policy applies, not this one.

This site keeps no download counter, no account and no email address. A click on a download button is not recorded here at all beyond the ordinary log entry for the page you were reading.

YouTube trailers

Some game pages have a trailer. The video is not loaded when the page opens. You see a still panel with a play button, and nothing is requested from YouTube until you press it.

If you do press play, the video is embedded from youtube-nocookie.com, operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. At that moment your IP address and details about your browser are sent to Google, and Google may store information on your device. If you are signed in to a Google account, Google can link the view to that account. This only happens because you chose to start the video, which is consent under Article 6(1)(a) GDPR, and you can withhold it simply by not pressing play. It can also involve a transfer of data to the United States.

Links to itch.io

Links on this site point to itch.io pages. Following a link is your decision, and from that point the privacy policy of itch.io applies. No data is passed to itch.io by this site before you click.

Fonts, styles and scripts

Fonts, styles and scripts are served from this site's own server. No Google Fonts and no content delivery network are involved.

Screenshots and cover art

Some screenshots and cover images are not stored on this server yet. Where one is missing, your browser fetches it from img.itch.zone, operated by itch corp. in the United States. At that moment your IP address and details about your browser reach that server, and data may be transferred to the United States.

The legal basis is Article 6(1)(f) GDPR, the legitimate interest in showing a complete page rather than an empty one. What itch corp. does with the data is set out in their privacy policy at itch.io/docs/legal/privacy-policy.

Contacting by email

If you write to badsky-games@gmx.de, your message and your email address are stored so the message can be answered. The legal basis is Article 6(1)(f) GDPR, or Article 6(1)(b) GDPR where your message concerns an agreement. Messages are deleted once they are dealt with and no legal retention period applies.

Your rights

Under the GDPR you can, at any time and free of charge:

• ask what data is held about you, under Article 15;
• have wrong data corrected, under Article 16;
• have data deleted, under Article 17;
• have processing restricted, under Article 18;
• receive your data in a portable format, under Article 20;
• object to processing based on legitimate interest, under Article 21;
• withdraw consent you have given, with effect from the moment you withdraw it.

Children

The games on this site are free and have no purchases, no chat, and no accounts. Nothing on this site is aimed at collecting data from children.
